WAIVER OF CLAIMS, RELEASE OF LIABILITY AND ASSUMPTION OF RISK

This Waiver of Claim, Release of Liability and assumption of risk (the "Waiver") is entered into on the date of signature by the undersigned individual ("Participant") and is effective upon execution. This Waiver applies to the Participant's voluntary participation in ice skating, use of rental equipment, and participation in any leagues, programs, and activities (collectively, "Activities") at the indoor rink known as The Polar Dome, owned and operated by Santa's Village LLC, located at 601 Dundee Ave. East Dundee, IL 60118 (the "Rink").

1. Assumption of Risk

The Participant acknowledges and understands that ice skating, use of rental equipment, and participation in leagues, programs, and activities at the Rink involve certain inherent risks, dangers, and hazards, including but not limited to, falls, collisions with other skaters, ice surfaces, or objects, the malfunction or improper use of rental equipment, and the risk of injury due to the nature of the activity. The Participant voluntarily assumes all such risks, both known and unknown, related to ice skating, use of rental equipment, and participation in the Activities at the Rink.

2. Release and Waiver of Liability

In consideration of being allowed to participate in ice skating, use rental equipment, and engage in leagues, programs, and activities at the Rink, the Participant, on behalf of themselves, their heirs, personal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue Santa's Village LLC, its employees, agents, officers, directors, affiliates, contractors, or any other individuals or entities involved in the operation of the Rink (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising from or related to any injury, loss, or damage (including but not limited to personal injury, property damage, or death) sustained during or as a result of ice skating, use of rental equipment, or participation in the Activities at the Rink, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification

The Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, losses, or damages, including legal fees, arising from or related to the Participant's actions, negligence, or failure to follow rules and regulations during their participation in ice skating, use of rental equipment, or engagement in any Activities at the Rink.

4. Rental Equipment

The Participant acknowledges and agrees that the use of rental equipment, including but not limited to skates, helmets, or any other items provided by the Rink, carries inherent risks. The Participant agrees to inspect any rental equipment prior to use and to report any issues or damage to Rink staff. The Participant assumes full responsibility for the safe use of any rental equipment, and acknowledges that the Released Parties are not liable for any injuries, losses, or damages resulting from the use or misuse of such equipment.

5. Compliance with Rules and Regulations

The Participant agrees to comply with all rules, regulations, and safety instructions established by Santa's Village LLC for ice skating, use of rental equipment, and participation in the Activities at the Rink. The Participant further acknowledges that failure to adhere to such rules may result in removal from the facility without refund.

6. Medical Authorization

In the event of an injury or medical emergency, the Participant authorizes Santa's Village LLC or its employees to seek medical treatment for the Participant, as deemed necessary, and agrees to bear the costs of any such treatment.

7. Acknowledgment of Understanding

The Participant acknowledges that they have read this Waiver in its entirety, understand its contents, and voluntarily accept the terms and conditions set forth herein. The Participant further affirms that they are of legal age and capacity to enter into this agreement or, if under the age of 18, that this Waiver has been signed by a parent or legal guardian.

8. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the state in which Santa's Village LLC operates the Rink, without regard to its conflict of laws principles.

9. Binding Effect of Agreement

The Participant acknowledges and agrees that this Waiver shall be effective and binding upon the Participant and their heirs, next of kin, executors, administrators, assigns, and legal representatives. In the event of the Participant's death or incapacity, this Waiver shall remain in full force and effect and be binding on the Participant’s heirs, successors, and assigns. This includes, but is not limited to, any claims arising out of the Participant’s participation in ice skating, use of rental equipment, and involvement in the Activities at the Rink.

By signing below, the Participant affirms that they have read, understood, and voluntarily agreed to the terms of this Waiver and Release of Liability. If the Participant is under the age of 18, this waiver is being signed by a parent of legal guardian.
